Quick reference guide for all notice types available in OntarioLandlord.

N1 - Rent increase
Purpose
Notify tenant of rent increase
Requirements
- 90 days minimum notice
- 12 months since last increase
- Within annual guideline for the effective-date year (1.9% for 2027, 2.1% for 2026)
- Effective date on first of rental period
Key points
- No voiding - tenant cannot prevent increase
- Building exemptions may apply (post-Nov 2018)
- AGI required to exceed guideline
N4 - Non-payment of rent
Purpose
Begin eviction for unpaid rent
Requirements
- 14 days minimum notice (7 days for daily/weekly tenancies)
- No rental-period alignment required — any date on or after the minimum is valid (RTA s.59(1)(b) sets only a floor)
- Accurate arrears amount
Key points
- Can serve as soon as rent is late
- Voidable: Tenant pays all arrears at any point before you file an L1 application
- Follow with L1 application if not paid
Voiding rules
Tenant must pay, at any time up until you file L1:
- All arrears stated on N4
- Plus any new rent that came due
The void window runs until L1 is filed — not just until the termination date. A full payment after the termination date but before you've filed L1 still voids the notice.
N5 - Interference, damage, overcrowding
Purpose
Address tenant behavior issues
Reasons
- Substantial interference with reasonable enjoyment
- Wilful or negligent damage
- Overcrowding
- Running illegal business
First N5
- 20 days notice
- Voidable: 7 days to correct behavior
Second N5 (within 6 months)
- 14 days notice
- Not voidable
N6 - Illegal acts
Purpose
Eviction for illegal activity
Reasons (wizard grounds)
- Illegal act in unit/complex (includes drug production/trafficking)
- Illegal business
- Misrepresented income (RGI housing)
Requirements
- 20 days notice for all three wizard grounds above (RTA s.61(2)(b)/s.60)
- RTA s.61(2)(a) allows 10 days specifically for drug production/trafficking, but this isn't a separate selectable ground in the wizard today
- Not voidable
- Document the illegal activity
N7 - Serious impairment of safety
Purpose
Eviction for safety concerns
Requirements
Reason 1 (Act impaired safety):
- 10 days notice
Reason 2 (Immediate threat):
- Can be immediate
Key points
- Not voidable
- High threshold - must be serious
- Document thoroughly
N8 - Persistent late payment
Purpose
Eviction for a repeated pattern of late rent payment (RTA s.58(2))
Requirements
- 60 days notice (monthly/yearly tenancies); 28 days (daily/weekly)
- Monthly+ tenancies must end on the last day of the rental period; daily/weekly tenancies don't require period alignment
- A documented pattern — 3+ late payments in the past 12 months is treated as a safe threshold
Key points
- Not voidable by paying rent (unlike N4) — the notice is about the pattern, not the current balance
- A single late payment isn't sufficient grounds; use N4 for that
N12 - Landlord's own use
Purpose
Unit needed for landlord or family
Who can request
- Landlord themselves
- Landlord's spouse
- Landlord's child or parent
- Same family for purchaser
Requirements
- 60 days notice
- One month rent compensation
- Good faith intention to occupy
Not eligible
- Corporate landlords cannot use Reason 1 (own/family use) — only individual owners, since Sept 1, 2017
- Purchaser's use (Reason 2) is blocked for buildings with more than 3 residential units (unless the unit is a condo)
Key points
- Must occupy for at least 12 months
- Bad faith has serious penalties
N13 - Demolition, conversion, repairs
Purpose
Unit needed for demolition or major work
Reasons
- Demolition
- Conversion to non-residential
- Repairs requiring vacancy
Requirements
- 120 days notice
- Compensation: 1 month's rent (buildings under 5 units) or 3 months' rent (5+ units)
- Building permits (if required)
Key points
- Right of first refusal to return — repairs only, not demolition or conversion
- Must be genuine need
Termination date rules
By notice type
Only N1, N5, N12, and N13 require the termination date to fall on the last day of a rental period. N4, N6, N7, and N8 (for daily/weekly tenancies) just need to be on or after the minimum notice period — any day is fine.

Service rules
OntarioLandlord does not currently add these days for you when calculating a termination date — the wizard uses same-day service. If you serve by mail or courier, build the extra days into the termination date you choose yourself.
